Transferring personal data to third countries
During the processing, the personal data are usually not transferred to non-EU third countries or to international organisations. If, in justified cases, there is a need to transfer personal data to non-EU third countries, VW SK will only transfer such personal data with the consent of the data subject or under the conditions of such transfer permitted by the Regulation or the Act.
Rights of the data subject related to the processing of personal data
Right of access to personal data
The data subject has the right to obtain from VW SK confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and additional information pursuant to Article 15 of the Regulation and/or §21 of the Act.
Right to rectification
The data subject has the right to request VW SK to rectify inaccurate personal data concerning him or her, or to have incomplete data completed without undue delay.
Right to erasure
The data subject has the right to request VW SK to erase personal data concerning him or her without undue delay, provided that the conditions under Article 17 of the Regulation and/or §23 of the Act are met (e.g., the purpose for which the personal data were processed no longer exists; the data subject has withdrawn consent to the processing of personal data and there is no other legal ground for the processing; the data subject has objected to the processing of personal data and there are no overriding legitimate grounds for the processing; the personal data have been unlawfully processed; the personal data have to be erased for compliance with a legal obligation; the personal data have been collected in relation to the offer of information society services directly to a child; all of the above provided that the conditions for the further processing of personal data by VW SK pursuant to the Regulation and/or the Act are not met.
Right to restriction of processing
The data subject has the right to request the restriction of processing of his/her personal data if the conditions under Article 18 of the Regulation and/or §24 of the Act are met (e.g., the accuracy of the personal data is contested by the data subject; the processing of personal data was unlawful; VW SK no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims; the data subject has objected to processing).
Right to data portability
The data subject has the right to obtain from VW SK the personal data, which he/she has provided to VW SK, in a structured, commonly used and machine-readable format. The data subject has the right to transfer those data to another controller without hindrance from the Company. Such data portability is permitted if the personal data of the data subject have been processed on the basis of the consent granted or under a contract and if the data have been processed by automated means. Where technically feasible, the data subject has the right to have the personal data transmitted directly from one controller (from VW SK) to another.
Right to object to the processing
The data subject has the right to object, on grounds relating to his/her particular situation, at any time to the processing of personal data which VW SK carries out for the reason of the performance of a task carried out in the public interest or in the exercise of official authority vested in VW SK or if the personal data are processed on the basis of the legitimate interest of VW SK or a third party, including to object to related profiling. The data subject also has the right to object to the processing of personal data for the purposes of direct marketing, including profiling to the extent that it is related to such direct marketing.
Right to withdraw the consent to processing
Where the personal data are processed on the basis of the consent of the data subject, the data subject has the right to withdraw such consent at any time. Such withdrawal has no effect on the lawfulness of processing the personal data of the data subject prior to the withdrawal.
Exercising the rights vis-à-vis VW SK
If the data subject decides to exercise any of the foregoing rights vis-à-vis VW SK in relation to the processing of personal data concerning him/her, he/she may do so in writing at the WV SK’s address, marking the envelope with the words “Data protection officer“, electronically at email address: osobneudaje@volkswagen.sk, or in person in the registered office of VW SK, Compliance/Risk management department.
Right to lodge a complaint with a supervisory authority
The data subject has the right to lodge a complaint with a competent authority responsible for the supervision of the processing of personal data. The Office for Personal Data Protection of the Slovak Republic is the competent supervisory authority in the territory of the Slovak Republic.
The data subject may seek the exercise of aforementioned rights at any time by sending an email to osobneudaje@volkswagen.sk, or in writing at the postal address of the Controller’s registered office. The Controller will handle the data subject’s request related to the aforementioned rights within statutory time limits.
